User Agreement

1. BASIC TERMS

1.1. Bank Card means an instrument for its holder to carry out transactions with money deposited with the bank that issued the Bank Card, in accordance with the Russian legislation and the agreement with the card-issuing bank.

1.2. Acquiring Bank means a bank that carries out technological and information interaction with the Museum as well as provides settlement services to handle online payments via bank cards to the Museum for its products and services.

1.3. Ticket means a document made on a limited-issue form (ticket, guided tour, subscription), granting the right of access to Events.

1.4. Refund means refunding the cost of an Online Order / Ticket in accordance with the terms and conditions of this User Agreement.

1.5. Museum means the Federal State Educational Institution of Culture “The Pushkin State Museum of Fine Arts”.

1.6. Client (User) means an individual who is of 18 years of age or older or an authorized representative of a legal entity, using the Bank Card based on the agreement with the card-issuing bank, registered on the Web-site and using the Web-site to get information and to order Tickets.

1.7. Parties means the Museum and the Client.

1.8. Order (Online Order) means an order that can be paid for via the Museum's Web-site and consists of a set of Tickets (one Ticket) for one Event selected by the Client on the Web-site and banded with the same identification number in the Museum's automated system for ticket booking and selling. Based on this identification number such Tickets are temporarily withdrawn (booked) from the total amount of Tickets on general sale.

1.9. Museum's Ticket Office means a ticket office of the Museum where individuals can receive Tickets against a prepaid Online Order. The Museum's Ticket Office is located at 14 Volkhonka (ticket office of the 19th and 20th Century European and American Art Gallery).

1.10. Event means a scientific and outreach event, including visits to the Museum's exhibitions and venues, indoor or outdoor concerts, excursions, subscriptions and any other events that can be attended by Ticket holders only.

1.11. Payment means a transfer of money in the amount of the Order Value to the Museum's bank account using the Bank Card.

1.12. System (Payment System) means a group of financial institutions cooperating under an agreement among them and ensuring communication and technological interactions required to make payments between the Client and the Museum.

1.13. Order Payment means the System's confirmation of debiting the money from the Client's Bank Card.

1.14. Purchase means the fact that the Order has been paid for, which is confirmed with the Online Order Payment Confirmation Form against which Tickets are issued at the Museum's Ticket Office.

1.15. Rules of Payment Systems means a set of documents regulating the activities of VISA and MasterCard payment systems.

1.16. Web-site means the Museum's web-site www.arts-museum.ru that includes, among other things, the tools for ordering online and interacting with the Payment System in order to pay for Online Orders.

1.17. Agreement means this User Agreement.

1.18. Online Order Payment Confirmation Form means a paper document confirming the Client's payment for their Online Order of the Museum's services on its Web-site. The Online Order Payment Confirmation Form is not a Ticket and does not grant the right of access to the Event.

The Online Order Payment Confirmation Form is intended to facilitate the search for the Client's prepaid Order in the automated system for ticket booking and selling in order to issue Tickets at the Museum's Ticket Office on the day of the visit in accordance with the prepaid Online Order.

1.19. Order Value shall be determined by the Parties for each Order based on the Museum's price list applicable as of the date of ordering on the Web-site.

1.20. Ticket Booking means a short-term reservation (withdrawal from the general sale so as to avoid duplicated selling) of the number of Tickets specified by the Client upon ordering online for a period from the ordering start point (clicking the Order button and simultaneously accepting the terms of this Agreement) until the Online Order Payment or the Client's refusal to pay for it, including a refusal implied by the Client's inactivity with regard to their Online Order confirmation and/or payment.

1.21. Inactivity Period means a period of time set by this Agreement within which the Client takes no actions to confirm and/or pay for their Online Order and upon the expiration of which the Ticket Booking is terminated (the Tickets are returned to general sale).

1.22. Day of the Visit means a day on which the Museum's services are actually used (the Event is attended).

1.23. Visiting Interval means a time period in calendar days starting from the date selected by the Client when ordering online, within which the Client, or any person named as the Ticket Recipient, may attend the Event; the Visiting Interval may not be extended even if it includes the Museum's days off when visitors are not allowed.

For any fixed-date Events, the Visiting Interval shall constitute One (1) business day and coincide with the Day of the Visit.

1.24. Recipient means an individual who is the recipient of Tickets at the Museum's Ticket Offices according to the information specified by the Client in their Order.

2. SCOPE OF THE AGREEMENT

2.1. This Agreement shall govern the relations between the Client and the Museum arising when the Client places and pays for their Order using the Web-site.

2.2. This Agreement is a contract between the Client and the Museum (hereinafter referred to as the 'Party', 'Parties'); it shall regulate the Client's using the Museum's Web-site and constitute a standard form contract of adhesion in accordance with Articles 426–428 of the Civil Code of the Russian Federation.

2.3. The capitalized terms used in this Agreement shall have the meaning specified in Section 1 hereof unless defined otherwise elsewhere in this Agreement.

3. ENTRY OF THE AGREEMENT INTO FORCE

3.1. This Agreement shall become effective once the Client has clicked the Order button and simultaneously accepted the terms and conditions of this Agreement during the online ordering process.

3.2. The Museum reserves the right to make changes to this Agreement without any further notice to the Client and notifies the Client, and the Client hereby acknowledges and agrees, that each and every time the Client wishes to place a new Order, the Client shall check with the text of the Agreement for any potential changes.

3.3. By ticking the checkbox next to 'I agree with the terms of this agreement' and specifying their e-mail in the registration form, the Client confirms their acceptance of this Agreement.

4. REGISTRATION

4.1. Registration on the Web-site:

When ordering, the Client shall fill out all the fields of the registration form (electronic questionnaire) on the Web-site.

4.2. The Client shall:

– specify their valid e-mail;

– specify their valid telephone number;

– enter the full name of the Ticket Recipient at the Museum's Ticket Offices;

– enter the security code sent by the Museum to the e-mail specified by the Client;

– accept this Agreement (see Clause 3.3 hereof).

5. RIGHTS AND OBLIGATIONS OF THE CLIENT

5.1. The Client shall fully comply with the terms and conditions of this Agreement.

5.2. The Client may order on the Web-site and get a Refund of their Payment in accordance with the provisions of this Agreement.

5.3. The Client may not reproduce, duplicate, copy, resale, publish on any other web-sites or use for any commercial or promotional purposes any information published on the Web-site, including information about any Tickets offered on the Web-site and their prices.

5.4. The Client shall attend the Event upon presentation of the Ticket issued at the Museum's Ticket Office based on the Online Order Payment Confirmation Form.

6. RIGHTS AND OBLIGATIONS OF THE MUSEUM

6.1. The Museum shall provide to the Client an opportunity to order Tickets via the Museum's Web-site as well as to return them and get a Refund in accordance with the terms and conditions hereof.

6.2. The Museum shall publish the prices of all Tickets that can be ordered on the Web-site. If reduced fee Tickets for qualifying persons are available on the Web-site, such Tickets will be issued at the Museum's Ticket Office only against a document confirming the visitor's eligibility.

6.3. The Museum shall have the right to change, at its sole discretion, the price of Tickets offered on the Web-site; however the Value of all and any prepaid Orders shall remain unaffected.

6.4. The Museum may send communications related to the Museum's services (including those connected with ordering) to the Clients.

7. RULES OF TICKET PURCHASE AND REFUND

7.1. Payment and Refund Currency

7.1.1. According to the laws of the Russian Federation, amounts of money debited from the Client's Bank Card shall be in Russian roubles.

7.1.2. Subject to the legislation of the Russian Federation, amounts of money refunded to the Client's Bank Card shall be in Russian roubles.

7.2. Procedure for Purchases Using Bank Cards

7.2.1. Having selected any required Tickets, the Client initiates the ordering process by clicking the Order button and simultaneously accepting the terms and conditions of this Agreement, and completes all stages of the process.

7.2.2. The Client may refuse to proceed with any unpaid Order at any time prior to the final confirmation of such an Order and the checkout if any terms and conditions hereof are unacceptable for the Client. The Inactivity Period from the time the Client clicks the Order button and simultaneously accepts the terms and conditions of this Agreement until the time of Online Order confirmation shall not exceed 30 minutes; the Inactivity Period from Order confirmation until the Order Payment shall not exceed 120 minutes.

7.2.3. To pay for their Order, the Client is automatically redirected to the web-site of the System where the details of the Client's Bank Card are checked.

In the Payment is successful, the amount equal to the Order Value is debited from the Bank Card. Where the Order Payment has not been made and/or has not been completed successfully, the Client may place a new Order and pay for it in accordance with Clause 7.2.

7.2.4. Upon successful booking of the Tickets under their Order, the Client receives an e-mail message sent to the e-mail address specified during the ordering process; the e-mail message contains a link to the Online Order Payment Confirmation Form for making payment and printing out the Form.

7.2.5. The Online Order shall be deemed to be delivered if the letter of notification confirming the successful payment has been sent by the Museum's e-mail server. Failure to deliver the said letter of notification or any other notices given to the visitor during the process of booking and paying for their Order shall not serve as a confirmation of the Museum's failure to deliver the Order because such letter delivery does not depend on the Museum. The Museum undertakes to do whatever is necessary to minimize any risks of such non-delivery: to verify the Visitor's e-mail address by sending them a security code: if such security code is not entered, the Client will not be able to proceed with their Order, including payment operations.

7.2.6. The Online Order Payment Confirmation Form is not a self-standing document confirming the Client's right to use the services. Before the service is provided on the day of their visit, the Client shall receive the Tickets at the Museum's Ticket Office within its opening hours specified on the Web-site. Tickets where the Event start time is specified (including Tickets for an exhibition with visit sessions) shall be received at the Ticket Office at least 30 minutes before the Event starts. All other tickets shall be received at least 1 hour before the Museum's closing time. After the periods specified in this Clause have expired, the Tickets of the Order may not be returned and the Museum and the Client agree that the Client has failed to receive Tickets under their Order due to their own fault and that the Museum shall be released from its obligation to refund the Payment under such Order unless irregularities resulting in the refusal to issue the Ticket are remedied within the period established for receiving Tickets under the Order.

7.2.7. To receive Tickets at the Museum's Ticket Office, the Order Recipient's identity document and the printed Online Order Payment Confirmation Form shall be presented. If the Order includes any reduced fee Tickets for qualifying persons the Recipient shall present a document confirming their eligibility for the benefit.

7.2.8. If the Client chooses, at their own discretion, to cancel their Order, the Client shall have the right to the Refund of the money they paid when placing such Order in accordance with Clause 7.7. hereof.

7.3. Refusal to Issue Tickets

7.3.1. The Museum may refuse to issue Tickets if:

(a) the System notifies the Museum of an actual or alleged fraudulent transaction performed using the Client's Bank Card before the Payment is refunded to the Client's Bank Card;

(b) the Tickets under the relevant Order were issued to the Client or an individual previously designated by the Client as the Recipient;

(c) the Recipient cannot be identified;

(d) the amount of Payment under the relevant Order had been refunded to the Client's Bank Card before the Client or the Recipient came to the Ticket Office to receive Tickets under the Order;

(e) the Recipient's personal data (full name) specified in the Online Order differs from the data specified in their identity document;

(f) the Museum's automated system for ticket booking and selling contains no information about the Online Order Payment as of the date of request;

(g) the Client or the Recipient fails to present any documents confirming their eligibility for the benefit when requesting reduced fee Tickets for qualifying persons at the Ticket Office.

7.3.2. The Parties have agreed that if the Museum refuses to issue Tickets for any of the reasons specified in Clause 7.3.1 hereof, the Museum and the Client acknowledge that the Client has failed to receive Tickets under their Order due to the their own fault and that the Museum shall be released from its obligation to refund the Payment under such Order unless irregularities resulting in the refusal to issue the Ticket are remedied within the period established for receiving Tickets under the Order.

7.3.3. If the Tickets under the relevant Order have not been actually received at the Museum's Ticket Office within the period specified in Clause 7.2.6, the Museum has the right to withdraw from its obligations hereunder unilaterally in accordance with the terms and conditions hereof and to consider its obligations to the Client to have been discharged in full.

7.4. Payment Security

7.4.1. The Client shall only make payments using their own Bank Card.

7.4.2. The security of Payments is ensured with the support of the Acquiring Bank that employs up-to-date protocols and technologies developed by Visa International and MasterCard Worldwide (3D-Secure:Verified by Visa, MasterCard SecureCode). The confidential data received from the Card Holder is processed by the Acquiring Bank's processing centre certified under PCI DSS. The security of information transferred is ensured by means of up-to-date Internet security protocols.

7.5. Order Cancellation

7.5.1. The Museum may cancel any Order in the situations specified in Clause 7.2.8.

7.5.2. The Museum may cancel the Order two (2) hours after its confirmation by the Client on the Web-site if the System has not confirmed the successful Payment.

7.5.3. The Museum may cancel the Order if any technical failure of the software and hardware system occurs during the ordering process. In that case, the Order Value will be refunded to the Bank Card used to make the relevant Payment in accordance with Clause 7.7.2.2 hereof.

7.6. Information Support of the Client

7.6.1. If the Client has any questions relating to ordering and making the Payment, the Client may contact the Museum on: +7 (495) 697-95-78 (Tuesday to Friday from 11.00 a.m. to 7.00 p.m.) or at: tickets@arts-museum.ru

7.7. Refunding Rules

7.7.1. Rules of refunding Order Payments at the Client's Request before the Client receives Tickets printed on the Museum's official stationery at its Ticket Offices

7.7.1.1. The Museum refunds only Payments for Orders placed on the Museum's Web-site using the Bank Card and only before the ordered Tickets have been received at the Museum's Ticket Offices. The Refund may only be paid to the Bank Card used to make the Payment.

7.7.1.2. To get the Refund of the Payment, the Client shall complete an application (hereinafter referred to as the ‘Application’). The Application shall include the following information:

– Client's full name;
– full name of the Recipient of Tickets;
– Order number;
– Client's passport details;
– e-mail address specified by the Client when ordering; name of the Bank Card holder (in Latin characters);
- last 4 digits of the number of the Bank Card used to make the Payment;
– Order date;
– Order Value;
– reason for return.

The completed Application Form shall be e-mailed to: tickets@arts-museum.ru. The Application shall be sent from the e-mail address specified by the Client during the ordering process no later than:

– 1 hour prior to the Museum's closing time:
 – on the day of the visit by an admission ticket;
 – on the last day of the Visiting Interval (for visits by a combined ticket) taking into account the Museum's business days when it is open to the public;
 – on the day of the visit when visiting an Event for which the start time is not specified;
– at 11:59 p.m. of the day preceding the Event date when visiting:
 – Events with a fixed date and time: lectures, concerts, public and other cultural outreach events with fixed date and time;
 – public guided tours (when purchasing an individual ticket to a public guided tour);
 – Museum's temporary exhibitions or permanent collection by an admission ticket with a fixed visiting session.
– three (3) days prior to the date of:
 – excursion if the Refund of a group guided tour is requested;
 – first session/event under a subscription if the Refund of an excursion subscription, lecture hall subscription or a subscription to the Museum's interest group activities is requested.

The Application shall be considered to have been received once the Application has arrived at the Museum's e-mail address.

The Museum reserves the right to reject any Application received after the specified period.

7.7.1.3. After receiving an Application for Refund, the Museum emails an automatically generated notice of delivery to the sender. If the notice of delivery has not been received, the applicant shall contact the Museum using contact details specified in Clause 7.6.1 to obtain the delivery confirmation. Otherwise, the Museum shall not be liable for non-delivery of the Application to the Museum.

7.7.1.4. Applications for Payment Refund are handled from Monday to Friday, 10:00 a.m.—05:00 p.m., Moscow Time. The Museum accepts Applications for handling only if the Client has met all conditions stated in Clause 7.7.1.2. The Application is handled within ten (10) business days.

7.7.1.5. When accepting Applications for Refund after the time periods specified in Clause 7.7.1.2, the Museum reserves the right not to refund the cost of Tickets to the Client.

7.7.1.6. Partial cancellation of an Order is not possible. Only the total number of Tickets included in any particular Order placed and paid for on the Web-site may be refunded.

7.7.2. Rules of refunding the price of Tickets purchased with the Bank Card on the Web-site and received at the Museum's Ticket Office

7.7.2.1. The price of the Ticket can only be refunded at the Museum's Ticket Offices.

7.7.2.2. The price of the Tickets can only be refunded to the Bank Card used to make the Payment.

7.7.2.3. To get the Refund of the Ticket price, the Client shall fill out the Application form (to be issued at the Ticket Office) with their own hand specifying the following information:

- full name (last name, first name and patronymic);
– passport details;
– e-mail address specified by the Client when ordering;
- name of the holder of the Bank Card used to make the Payment;
– Online Order date;
- Order Value and number;
– reason for return.

(the name of the card holder in Latin characters as it appears on the Card); the last 4 digits of the number of the Bank Card used to make the Payment; date of the Order, Order Value, reason for return, and a copy of their passport.

7.7.2.4. The Application for Refund shall be submitted to the Ticket Office at least:

– 1 hour prior to the Museum's closing time:
 – on the day of the visit by an admission ticket;
 – on the last day of the Visiting Interval (for visits by a combined ticket) taking into account the Museum's business days when it is open to the public;
 – on the day of the visit when visiting an Event for which the start time is not specified;
– 30 minutes prior to the Event start time when visiting:
 – Events with a fixed date and time: lectures, concerts, public and other cultural outreach events with fixed date and time;
 – Museum's temporary exhibitions or permanent collection by an admission ticket with a fixed visiting session.
 – public guided tours (when purchasing an individual ticket to a public guided tour);
– three (3) days prior to the date of:
 – excursion if the Refund of a group guided tour is requested;
 – first session/event under a subscription if the Refund of an excursion subscription, lecture hall subscription or a subscription to the Museum's interest group activities is requested.

7.7.2.5. If the Refund of the Ticket price is requested after the Ticket has been received at the Museum's Ticket Office, the Client will be refunded the price of the Ticket. The Museum reserves the right to withhold the amount of any expenses actually incurred by the Museum. The Application for Refund will be processed within ten (10) business days.

7.7.2.6. To get the Refund at the Ticket Office, the Client shall present their identity document and return the Ticket.

7.7.2.7. If Applications for Refund are submitted after the deadlines stated in Clause 7.7.2.4, the Museum reserves the right not to refund the cost of Tickets to the Client.

7.7.2.8. Where the Client orders the Museum's services that include a set of Events (subscription, combined ticket), then such Order shall not be subject to refund after the Client has attended the first Event or any area included in the combined Ticket. After the sessions included in a subscription start, such subscription shall not be subject to refund even if the Client or the Recipient of the Order failed to attend that session; neither full, nor partial refund is allowed.

7.7.3. Rules of refunding Tickets at the Museum's Initiative

7.7.3.1. Where the Payment is refunded due to the cancellation or replacement of any Event (provided that the Ticket is refundable) or due to any technical failure resulting in incorrect Order generation or Payment, the Museum shall cancel such an Order and refund the total amount of the Payment to the Client. The Museum informs the Client about cancellation, replacement or rescheduling of the Event by publishing such information on the Museum's Web-site.

7.7.3.2. The Parties have agreed that the Refund given by the Museum with regard to any Payment under the relevant Order in accordance with the terms and conditions of this Agreement and/or the Rules of International Payment Systems and the laws of the Russian Federation shall be recognized by the Parties as a reasonable ground for the Museum to terminate its obligations under this Agreement and to consider its obligations to the Client to have been discharged in full.

7.8. Date of Refund

The Payment shall be considered to have been refunded on the day when the money was debited from the transit account of the Acquiring Bank. The Museum shall not be liable for any further transfer of the money.

8. PRIVACY POLICY

8.1. The Museum undertakes not to disclose the information received from the Client. The Museum shall not be deemed to be violating this Agreement when it discloses such information to any third parties contracted by the Museum in order to perform its obligations to the Client. The Museum shall provide access to the personal data only to those of its employees, subcontractors and agents who need to know this information to ensure the functioning of the Web-site and the provision of services to the Client.

8.2. The Client's data shall be processed in accordance with the laws of the Russian Federation. The Museum processes the Client's data in order to provide services to the Client, check, examine and analyse such data and to contact the Client. The Museum shall take all necessary and reasonable actions to protect the Client's data against unauthorised access and disclosure of such data.

8.3 By accepting the User Agreement on the Web-site, the Client agrees to the processing of their personal data, using any automation technology or otherwise, including collection, organization, accumulation, storage, adjustment (updating, alteration) retrieval, use, distribution (including data transfer), depersonalization, blocking, erasure or destruction of personal data provided by the Client in connection with the performance of this Agreement as well as any other operations provided for in Federal Law No. 152-FZ On Personal Data dated July 27, 2006.

8.4 The Museum is not responsible for verifying the accuracy of the Client's data or reviewing whether they are up-to-date, but assumes that the Client provides accurate and adequate data when completing the registration form and keeps this information updated. The Client shall be solely liable for any potential adverse effects resulting from the Client's providing inaccurate or false data.

8.5 The Museum may use the information provided by the Client to ensure the compliance with the applicable laws (including the prevention and/or curtailment of any illegal or abusive practices of the Client). The information provided by the Client may only be disclosed in compliance with the applicable law by order of the court, law enforcement agencies or as otherwise required by the applicable laws.

9. LIMITATION OF LIABILITY

9.1. The Client shall use the Web-site and the functionality provided to the Client at their own risk. The Museum shall not be liable for the improper use of the Web-site by the Client as well as its suitability for their purposes or its conforming to their expectations.

9.2 The Museum shall not be held liable under any contracts between the Client and any third party.

9.3. The Museum shall have the right to terminate, at its own discretion, the Web-site operations or any part of its functions without any prior notice to the Client. The Museum shall not be liable for any suspension or termination of its Web-site operations.

9.4. The Museum shall make its best efforts to ensure the proper functioning of its Web-site; however the Museum shall not be liable for failure to perform or improper performance of its obligations to the Client hereunder with regard to the indemnity of any damage (loss), whether direct or indirect, resulting from the unavailability of its Web-site.

9.5. The Museum's Web-site operations can be suspended without any notice to the Client in case of any force majeure event, or faults and failures of the hardware and software systems of any third parties cooperating with the Museum, or any third parties' actions (or inaction) intended to suspend or stop the operation of the Web-site.

9.6. The Museum shall not be liable for time periods within which banks or other organizations make Payments, including the periods for refunding the Client's Payments.

9.7. In no event shall the liability of the Museum exceed the cost of the Tickets purchased by the Client.

9.8. The Parties shall not be liable for failure to perform all or any part of their obligations if such failure is due to force majeure circumstances arising after this Agreement has come into effect and caused by any extraordinary events that parties could not reasonably foresee or prevent.

9.9. The Museum shall not be liable in connection with any disputes or disagreements between the Client and the System and/or credit institution relating to any Payments.

10. FINAL PROVISIONS

10.1. This document constitutes an entire Agreement between the Client and the Museum and establishes the terms of use of the Museum's Web-site. Should there be any discrepancies between the text of the Agreement published on the Web-site and any other text hereof, the former shall prevail.

10.2. Any matters not covered in this Agreement shall be regulated in accordance with the laws of the Russian Federation.

10.3. Should there be any disputes or disagreements relating to this Agreement and its scope, the Museum and the Client shall make their best efforts to resolve them by the way of negotiation. Any dispute that the Parties fail to resolve by the way of negotiations shall be referred to and resolved by court in accordance with the applicable laws of the Russian Federation.

10.4. The Client hereby confirms that he/she has read and accepts all terms and conditions of this Agreement in their entirety (and without reservation). The Client hereby agrees to observe all terms and conditions of this Agreement in their relationship with the Museum.

List of documents that can be used to confirm the identity of the Recipient of Tickets received under Online Order at Ticket Offices of the Pushkin State Museum of Fine Arts:

  • internal Russian passport;
  • seafarer's passport (identity document);
  • international passport of the Russian citizen;
  • passport of the foreign citizen;
  • certificate of birth;
  • identity document of the military person;
  • identity document of the person without citizenship;
  • temporary identity document issued by internal affairs agencies;
  • military card of the army conscript;
  • residence permit of the foreign citizen or person without citizenship;
  • certificate of release from prison;
  • passport of the USSR citizen;
  • diplomatic passport;
  • service passport (except for seafarer’s identity document and diplomatic passport);
  • certificate of return from a CIS country;
  • certificate of passport loss;
  • refugee identity card;
  • Russian Federation provisional asylum letter;
  • Russian Federation temporary residence permit;
  • driving license issued in the Russian Federation (if it has a photo);
  • Russian Federation pensioner’s identity document (if it has a photo);
  • student’s identity card of a Russian university/college (if it has a photo);
  • student’s record book of a Russian university/college (if it has a photo);
